Beta Test Terms and Conditions

The App is provided in a pre-release beta form for testing, evaluation, and feedback purposes only.

You acknowledge and agree that the App:

• may contain bugs, errors, defects, or security vulnerabilities;
• may not operate as intended;
• may be modified, suspended, restricted, or discontinued at any time;
• may experience interruptions or downtime;
• may result in the loss of data or content; and
• is not intended for production, critical, emergency, or high-risk use.

By participating in the beta testing program, you represent and warrant that:

• you are at least 18 years of age, or have the consent of a parent or legal guardian;
• any information you provide to us is accurate and complete; and
• you will use the App in accordance with these Terms and all applicable laws.

Our collection, use, storage, and disclosure of personal information is governed by our Beta Privacy Policy. By participating in the beta testing program, you acknowledge that you have read and understood our Beta Privacy Policy.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the App solely for the purpose of participating in the beta testing program.

You must not:

• sell, sublicense, distribute, or transfer access to the App;
• permit any third party to access the App through your account;
• use the App for commercial purposes without our prior written consent; or
• use the App in any manner inconsistent with these Terms.

You acknowledge that the App and all non-public information relating to the App constitute confidential information.

Without our prior written consent, you must not:

• disclose confidential information to any third party;
• publish or distribute screenshots, recordings, demonstrations, reviews, or descriptions of unreleased features;
• provide access to the App to another person; or
• use confidential information for any purpose other than participating in the beta testing program.

This clause survives termination of your participation in the beta testing program.

We welcome feedback regarding the App. If you provide any suggestions, ideas, comments, recommendations, bug reports, feature requests, or other feedback ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free, transferable licence to use, reproduce, modify, adapt, publish, and otherwise exploit that Feedback for any purpose without compensation or attribution.

All intellectual property rights in and relating to the App, including its software, content, functionality, branding, designs, documentation, and associated materials, remain our property or the property of our licensors.

Nothing in these Terms grants you ownership of any intellectual property rights in the App.

You must not:

• use the App for any unlawful purpose;
• interfere with or disrupt the operation of the App;
• attempt to gain unauthorised access to any systems, accounts, or data;
• reverse engineer, decompile, disassemble, or attempt to extract source code from the App, except to the extent permitted by law; or
• use the App in a manner that could damage, disable, impair, or compromise the App or related systems.

If the App permits users to communicate, collaborate, share content, or otherwise interact with one another, you agree to interact respectfully and lawfully.

You must not:

• harass, threaten, intimidate, bully, or abuse other users;
• post, share, transmit, or otherwise distribute unlawful, defamatory, misleading, fraudulent, offensive, or inappropriate content;
• impersonate another person or misrepresent your identity or affiliation;
• collect, use, or disclose another user's personal information without their consent;
• send spam, unsolicited communications, or promotional material;
• upload or distribute malicious software, code, or content; or
• engage in conduct that may interfere with another user's enjoyment of the App.

We reserve the right to investigate suspected breaches of this clause and may remove content, restrict features, suspend accounts, or terminate access where we reasonably consider that a user has breached these Terms.

You are responsible for any content, information, files, messages, comments, or other material that you upload, submit, publish, or share through the App ("User Content").

You represent and warrant that:

• you have all necessary rights to submit the User Content;
• the User Content does not infringe any third-party rights; and
• the User Content complies with these Terms and applicable laws.

We do not claim ownership of your User Content. However, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, transmit, and display User Content to the extent reasonably necessary to operate, maintain, and improve the App.

We may remove User Content that we reasonably believe breaches these Terms or applicable laws.

To the maximum extent permitted by law, the App is provided on an "as is" and "as available" basis.

We make no representations or warranties, express or implied, regarding:

• the availability of the App;
• the accuracy of any information provided through the App;
• the security or reliability of the App;
• the suitability of the App for any particular purpose; or
• uninterrupted or error-free operation of the App.

To the maximum extent permitted by law, we exclude all liability for any loss, damage, cost, expense, or claim arising from or relating to:

• your participation in the beta testing program;
• your use of, or inability to use, the App;
• any interruption, defect, bug, error, security vulnerability, or malfunction of the App; or
• any loss of data, content, profits, revenue, business opportunities, or goodwill.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded under applicable law, including the Australian Consumer Law.

We may suspend, restrict, or terminate your access to the App at any time, with or without notice and for any reason.

You may cease participating in the beta testing program at any time.

Upon termination:

• your right to use the App immediately ceases; and
• you must stop accessing and using the App.

We may modify, update, suspend, discontinue, or cease development of the App or the beta testing program at any time without liability to you.

Participation in the beta testing program does not entitle you to:

• continued access to the App;
• access to future versions of the App;
• ownership rights in the App; or
• compensation of any kind.

We may amend these Terms from time to time. Where practical, we will notify participants of material changes. Continued use of the App following any update constitutes acceptance of the revised Terms.

These Terms are governed by the laws of New South Wales, Australia.

You submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from those courts.
